By accessing or using the CityCharge app, website (chargethecity.com), or renting a portable charger from any CityCharge kiosk, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, do not use our services.
These terms constitute a binding legal agreement between you ("User") and Chargethecity Inc. ("CityCharge," "we," "us," or "our"), a Delaware C-Corp.
CityCharge provides portable phone charger rentals through self-service kiosks located at partner venues including entertainment venues, transit hubs, and other high-traffic locations. Users rent a charger from any CityCharge kiosk and return it to any CityCharge kiosk when finished.
CityCharge does not guarantee charger availability at any particular kiosk or time. CityCharge does not guarantee that all kiosks will have available return slots at all times — if you cannot find a return slot, contact support.
Approach any CityCharge kiosk and scan the QR code or use the app to release a charger. Use the charger to charge your personal device only. Return the charger to any CityCharge kiosk when finished.
Before each use, inspect the charger for visible damage — if damaged, do not use it and report it through the app or to support@chargethecity.com.
You may not:
Failure to return a charger within 72 hours of rental will result in a replacement fee of $45 charged to your payment method. If a charger is returned in damaged condition due to user fault, you will be charged the cost of repair, up to the full replacement value of $45.
CityCharge reserves the right to pursue civil remedies for unreturned, lost, or stolen equipment.
By creating a CityCharge account, you consent to receive transactional SMS messages. Message types include verification codes, rental confirmations, return reminders, and payment updates. CityCharge does not send marketing or promotional SMS.

All content on the CityCharge app and website — including text, graphics, logos, images, software, and the CityCharge brand name — is the exclusive property of Chargethecity Inc. or its licensors. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or exploit any CityCharge content without our prior written consent.
The CityCharge name, logo, and trademarks may not be used without our written permission. We grant you a limited, non-exclusive, non-transferable, revocable license to use the CityCharge app for your personal, non-commercial use, subject to these terms.
You agree to indemnify, defend, and hold harmless Chargethecity Inc., its officers, directors, employees, agents, and partners from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: your use of the service; your violation of these terms; your violation of any third-party rights; your negligence or willful misconduct; or any unauthorized use of your account.
CityCharge services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. CityCharge does not warrant uninterrupted or error-free service.
To the fullest extent permitted by law, CityCharge shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to device damage, data loss, personal injury, or interruption of service.
CityCharge's total liability to you for all claims shall not exceed the total fees you paid to CityCharge in the six months preceding the claim. Some jurisdictions do not allow limitation of certain damages — in such jurisdictions, liability is limited to the greatest extent permitted by law.

You may terminate your account at any time by contacting support@chargethecity.com. We may suspend or terminate your account at any time if you breach these terms, fail to pay outstanding charges, or if continued use would be detrimental to the service or other users.
Upon termination, all outstanding financial obligations remain in effect. We reserve the right to pursue claims for any prior breaches.
CityCharge may modify these terms at any time. We will notify users of material changes through the app or via email. Continued use after modifications constitutes acceptance. If you do not agree with changes, you must stop using the service.
These terms are governed by and construed under the laws of the State of Delaware, without regard to conflict of law provisions. Any legal proceedings arising from these terms shall be brought in the state or federal courts located in Delaware. You consent to the exclusive jurisdiction and venue of such courts.
Any cause of action must be commenced within the applicable statute of limitations.
